John died. John W. Daily was a deligate to the first convention for the formation of the State of West Virginia, in 1861. At the same time he was elected to a seat in the legislature for the reorganization of Eastern Virginia, but refused it, as that would compromise the right of this county [Berkeley] to go with old Virginia. He was bitterly opposed to secession.

The Will of John Boley Gorrell
In the name of God, Amen.
I John B. Gorrell of the County of Pettis and State of Missouri being of sound mind and memory and considering the uncertainty of this frail and transitory life do, therefore, make public and disclose this to be my last Will and Testament that is today.
First. It is my desire that all my just debts be paid and after the payment of my debts that the residue of my estate be disposed of as follows:
Second. To my faithful and beloved wife Mary H. I give and bequeath all my property both real and personal to be held and enjoyed by her during her natural life, with the request that all rents and profits received from said property over and above the amount necessary for her maintenance and support shall be used and expended for the maintenance, education and support of my minor children until they become of age.
Third. On the death of my said wife it is my wish that each of my younger children be given an amount that including prior advances will make each of their portions equal to the amount advanced to each of my live oldest children. And to guard against any misunderstanding I here assert that the advances made to my children up to this date are as follows:
To William T. my oldest son money, stock, household furniture and farming implements, valued at fifteen hundred dollars ($1500.00)
To James T. my second son money, stock, household furniture and farming implements valued at fifteen hundred dollars ($1500.00)
To Nancy E. in stock and household furniture valued at three hundred and twenty-five dollars ($325.00)
To John B. in stock and household furniture, three hundred and twenty-five dollars ($325.00)
To Nathan V. one horse bridle and saddle valued at one hundred and fifty dollars ($150.00)
Abraham H., Jacob H., Mary Virginia, Joseph B. and Susan Frances, being minor heirs have received nothing up to this date.
Fourth. After all of my children have been made equal including - allowances it is my desire that the residue of my estate be equally divided between all of my children, share and share alike. Should my executors find it necessary to sell real estate for the payment of debt or for the education and support of my minor children, or consider it advantageous to the estate to tell a part of the real estate for any purpose, they are hereby empowered to sell the north west quarter of the north west quarter of section two (2) in Township Forty Six (46) of Range twenty one (21) and no other, at private sale, on such times as they may deem best.
My said wife or my executor may make allowances to my younger children as they become of age provided they ask and are given therewith. But in no case shall the amount advanced to any child exceed the highest amount allowed to any one of my children named my life time. After the death of my said wife my surviving executor shall sell all of the property both real and personal belonging to my estate in such measures as he may deem most advantageous to the estate and after paying all expenses and a reasonable compensation for his trouble, he shall divide the proceeds of said sale amongst the heirs as herein before denoted.
I hereby make, constitute and appoint my said wife Mary H. Gorrell and my son Nathan V. Gorrell to be executors of this my last will and testament, thereby revoking all former wills by me made.

Gorrell, the testator subscribed the same in their presence and published and declared said will an instrument of writing to be his last will and testament and that at the time of signing the same he the said testator was of sound and disposing mind and more than twenty-one years of age, and that said deponents attested said will as witnesses thereto, by subscribing their names to the same in the presence of the testator and of each other, and at the request of the said testator.
